Appeals Court Lifts Funding Freeze
The Modipane-Mabalane Road Project, previously stalled by a court order, is now poised to resume. The Court of Appeal (CoA) has reversed interim injunctions that had frozen project funds belonging to Pro-Serve Consulting Botswana and halted construction.
Procedural Issues Cited in Ruling
The CoA’s decision stemmed from significant procedural and disclosure shortcomings identified in the initial legal challenge. The court found that Tau Grading, the party that initiated the injunction, had improperly sought the original orders. This legal misstep led to the initial freeze on project funds and the subsequent halt in road construction.
Project Resumption Expected
With the Court of Appeal’s ruling, the financial constraints on Pro-Serve Consulting Botswana have been removed, clearing the path for the Modipane-Mabalane Road Project to proceed. The unblocking of these funds is expected to allow for the swift resumption of work on the critical infrastructure development.
